PRELIMINARY POINTS OF DISCUSSION
AperioFlow, LLC ("AperioFlow", "we", "us", "our") provides an array of team communication, task management, and organizational tools, as outlined further in the AperioFlow User Manual and Release Notes (collectively, the "Service"), as well as our websites, inclusive but not limited to www.AperioFlow.com, plugin.AperioFlow.com (the "Websites"). It is important to clarify that while AperioFlow is developed and offered by AperioFlow LLC, it is not officially affiliated with Atlassian or Jira. AperioFlow operates as a separate and independent product, designed to complement Jira's project management capabilities. By agreeing to these Terms of Service, you acknowledge and understand that AperioFlow is a distinct offering from AperioFlow LLC and is not an official product of Atlassian or Jira.
These User Terms of Service ("Terms") represent a binding legal agreement between you and AperioFlow, outlining the rules that govern your use of our Service and Websites. These Terms apply to you as a user of the Service, barring exceptions that apply to Registered Users (as defined and further detailed below in the section titled "Understanding These Terms; Users and Clients"). By accessing or using the Service and Websites, you acknowledge and consent to be bound by these Terms (where applicable) and affirm that you have read and understood our Privacy Policy, which is incorporated herein by reference.
If you disagree with these Terms, kindly refrain from accessing or using the Service or Websites.
We may revise these Terms from time to time by posting a revised version on our website. If, at AperioFlow's sole discretion, the amendments to these Terms are significant, we will provide you with a reasonable notice prior to the changes taking effect, either by emailing the email address associated with your account or by notifying you via the Service and/or Websites. If you disagree with or cannot comply with the amended Terms, you must discontinue using the Service and Websites. Unless otherwise stated elsewhere in these Terms or in our notice, the updated Terms will take effect upon their posting and will apply moving forward. Your continued use of the Service and Websites following any update to these Terms signifies your acceptance of such changes.
UNDERSTANDING THESE TERMS; USERS AND CLIENTS
By using AperioFlow, you fit into one or more of the following three categories of AperioFlow user:
- "Website Visitors" are users of the Websites.
- "Basic Users" use the free version of the Service. Basic Users have access to a more restricted set of Service features and functionality than Registered Users. Basic users may have their own individual workspaces and/or participate in a free multi-user AperioFlow domain.
- "Registered Users" use the Service as part of any paid AperioFlow subscription plan purchased by a person or entity (the "Client") who has separately entered into a written agreement with AperioFlow (the "Client Agreement") that governs the access and use of the Service and permits that Client to create and configure AperioFlow so that Registered Users may join. In the event you are a Registered User, only the following sections of these Terms will apply to you: "Preliminary Points of Discussion" and "Understanding These Terms; Users and Clients".
